Terms of Service

2. Your responsibilities

• You will use the services only in compliance with these terms and applicable law, including data protection law in every jurisdiction where your employees are located.
• You are responsible for informing your employees about the sensors you deploy, and for any lawful basis the law requires before enabling optional content capture.
• You will run the scanner only against endpoints you own or are authorized in writing to test.
• You will not reverse engineer the services, resell them without a partner agreement, or use them to build a competing product.

3. Data and privacy

You own your data. Lustena processes it as a processor on your behalf, as described in the Privacy Policy and the Trust Center. Findings produced by the browser extension are content-free by construction. Optional redacted content capture is off by default, requires a lawful basis you record, and is encrypted at rest with every read audited.

Lustena may collect and analyze aggregate, de-identified data about the use and performance of the services to improve them, and will not identify you or your employees from it.

4. Fees

Free plans are provided at no cost within the limits published for that plan on the Plans page. Paid plans are invoiced as agreed in the order form. Fees are exclusive of taxes. Lustena will give notice before any change to fees that affects a running term.

5. Term and termination

These terms apply from your first use of the services until terminated. Either party may terminate with thirty days' notice, or on written notice if the other party materially breaches these terms and fails to cure the breach within thirty days of being notified. After termination you may export your data for thirty days; it is then deleted.

6. Confidentiality and intellectual property

Each party will protect the other's confidential information with the same care it uses for its own, and at least reasonable care. Lustena and its licensors own the services and the software. Open-source components are licensed under their own terms. You own your data and anything you generate from it.

7. Warranty and disclaimer

Lustena will maintain the services in a manner that minimizes errors and interruptions. Except as stated here, the services are provided as is, and Lustena disclaims all other warranties, express or implied. Lustena does not warrant that the services will detect every piece of sensitive data, every agent, or every weakness in an agent; coverage limits are documented and shown in the product.

8. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental or consequential damages, and Lustena's aggregate liability under these terms is limited to the fees paid in the twelve months before the claim.

9. General

If any provision is unenforceable, it will be limited to the minimum extent necessary. These terms are the entire agreement on their subject. Governing law and venue are those stated in your order form; absent an order form, the laws of the State of Delaware apply and the courts of Delaware have jurisdiction. Lustena may update these terms by posting a new version with a new date; material changes are notified to workspace admins at least thirty days in advance.
